Legal Terms of Use

 

MÄK Technologies, Inc. (MÄK) offers you the right to use the VR-TheWorld Online service (the “Service”) only under the terms contained in this document (the “Terms”).  By accessing the VR-TheWorld Online service, or by accessing any of the content available through the service, you agree to be bound by all of the Terms.

 

1.      Use of the Service

 

The VR-TheWorld Online Service is provided free of charge for real-time, online use by client applications that are based on MÄK’s VR-Forces or VR-Vantage toolkits (including VR-Forces SimEngine, VR-Forces GUI, VR-Vantage Stealth, VR-Vantage IG, VR-Vantage XR, and 3^rd party application based on the VR-Forces or VR-Vantage SDKs).

 

The VR-TheWorld Online Service is provided free of charge for real-time, online trial use and evaluation only, by client applications (including web applications) that are not based on MÄK’s VR-Forces or VR-Vantage toolkits.

 

MÄK grants you a non-exclusive, non-transferable license to access the Service subject to these Terms.

 

Any other use requires prior written permission from MÄK.

 

2.      Content

 

The VR-TheWorld Online service provides access through web-services to various content, including imagery, map data, elevation, terrain geometry, and vector data (“Content”).  You acknowledge that the Content is owned by MÄK, or by third parties (including Pelican Mapping), who have licensed their data to MÄK under terms that allow MÄK to offer access under the Terms of the Service.  The Content is subject to copyright and other IP rights owned by the companies that have provided the data.  Use of the Content is permitted only in conjunction with the Service, and only under the Terms.

 

3.      Changes to the Terms

 

MÄK reserves the right to change the Terms at any time, and the updated Terms will be posted on VR-TheWorld.com immediately upon revision.  By using the Service, you agree to be bound by the Terms that are posted at the time of your use.

 

4.      Restrictions

 

You may not:

·    Modify the Content, or create derivative works from the Content

·    Redistribute or sublicense the content

·    Sublicense or transfer the right to use the Service

·    Reverse engineer the source code of the Service

·    Use the Service in a way that limits the rights of others to use the Service

 

5.      Offline Use

 

The Content is intended for online use by applications that are querying the Service through web-mapping protocols.  Caching or bulk-downloading the data for offline use is prohibited.  An exception is that users of VR-Forces or VR-Vantage-based applications may use the caching feature available in those products to cache reasonable, limited amounts of data for performance optimization, or for the purpose of demonstrating those products in an offline environment only.

 

6.      Disclaimer of Warranty

 

The Service and Content are provided “as-is”, and you agree to use them at your own risk.  MÄK and its licensors disclaim any warranties regarding the accuracy, quality, or completeness of the Content, or its suitability for any particular purpose.   MÄK and its licensors disclaim any warranties regarding the reliability, quality, latency, performance, and availability of the Service.

 

7.      No Commitment of Future Availability

 

The Service is provided free of charge, with no commitment to continue to provide it in the future.  MÄK reserves the right to terminate the Service at any time, for any reason.  We also reserve the right to cease providing the Service for free, and to charge a fee for future use.

 

8.      No Commitment of Uptime or Quality of Service

 

MÄK is providing the Service primarily as a way of demonstrating the capabilities of the commercial VR-TheWorld Server product upon which the Service is based, and as a way of demonstrating the streaming terrain capabilities in VR-Vantage and VR-Forces.  While the use of the Service from within VR-Vantage and VR-Forces-based applications is not limited to trial and evaluation purposes, we do not recommend relying on the free online Service for mission-critical applications, or applications that require the Service to be “always available”.  In particular, MÄK anticipates that there will be periods of unannounced, unscheduled downtime when we are upgrading the version of the Server upon which the Service runs, and when we add or modify the Content.  MÄK makes no commitments that the Service will be “always available”, or that the performance of the Service will be at a level necessary for use in real-time applications.

9.      Right to Deny Use

 

MÄK reserves the right to deny use of the Service to any party, for any reason.

 

In particular, if an individual’s use of the Service is causing data to be downloaded at a rate that compromises other users’ ability to access the Service, we reserve the right to terminate that individual’s right to use the Service.
